Contractor Terms of Service
Amigos Dive Center — Cave Country, Florida

These Terms of Service (“Terms”) govern the relationship between you (“Contractor”) and Amigos Dive Center (“Company”) when you provide services through our platform as a dive instructor, dive guide, underwater photographer, or rental property owner.
1. Commission Structure
Service Booking Commission: For each booking made through the Amigos Dive Center website, the Contractor receives 85% of the total booking price and the Company retains 15%. This 15% covers website hosting, marketing, booking management, payment processing, and administrative support.
Referral Commission: Contractors may earn a 10% commission on all purchases made by new customers referred through the Contractor’s unique referral link. This referral commission is valid for 12 months from the date the customer first registers through the referral link. After 12 months, the referral commission drops to 0%.
2. Contractor Responsibilities
As a Contractor, you agree to:
- Maintain current and valid certifications for your role
- Carry appropriate liability insurance at all times
- Provide services in a professional and safe manner
- Respond to booking requests in a timely manner
- Communicate availability changes to Amigos Dive Center promptly
- Comply with all applicable local, state, and federal laws
3. Independent Contractor Status
You are an independent contractor, not an employee of Amigos Dive Center. You are responsible for your own taxes, insurance, and business expenses. Amigos Dive Center does not provide workers’ compensation, health insurance, or any other employee benefits.
4. Fees and Payment
Commission payouts are processed via your chosen method (PayPal or bank transfer). The Company reserves the right to withhold payouts pending resolution of disputes, chargebacks, or policy violations. You are responsible for any fees charged by your payment provider.
5. Limitation of Liability
You agree to hold Amigos Dive Center harmless from any loss of funds, damages, injuries, or other liabilities that may arise in connection with services you provide through the platform. Amigos Dive Center will not be responsible for any indirect, incidental, special, or consequential damages resulting from your use of our platform or services.
6. Indemnification
You agree to indemnify, defend, and hold harmless Amigos Dive Center, its owners, employees, and agents from any claims, demands, losses, damages, or expenses arising from your services, your breach of these Terms, or your violation of any law or regulation.
7. Disclaimers
Amigos Dive Center makes no representations or warranties regarding the number of bookings you will receive, the amount of commission you will earn, or the results of your participation in the contractor program. You assume all responsibility and risk for the services you provide.
8. Cancellation and Termination
Either party may terminate the contractor relationship at any time, for any reason, with or without notice. Upon termination, any pending commissions will be paid according to the standard payout schedule. Amigos Dive Center reserves the right to remove your listing immediately if you violate these Terms or engage in conduct that reflects negatively on the Company.
9. Listing and Content
Your service listing on the Amigos Dive Center website is subject to approval and editing by the Company. The Company reserves the right to modify listing content for clarity, accuracy, and consistency with site standards. You retain ownership of any photos, descriptions, or content you provide.
10. Changes to Terms
Amigos Dive Center reserves the right to change these Terms at any time. Changes will be posted on this page and become effective immediately upon posting. Continued participation in the contractor program constitutes acceptance of updated Terms.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Florida. You irrevocably submit to the exclusive jurisdiction of the courts in that state.
